Advertising Terms and Conditions

2024 Lakeland Cabin Stuffer

These terms and conditions govern all orders for print, digital and preprint advertising placements published by be smart communications through the Lakeland Cabin Stuffer.

1.    Scope

The Lakeland Cabin Stuffer (~5500 to 6000 copies) is printed once a year and distributed in Saskatchewan’s Lakeland and surrounding area including: Christopher, Emma, Anglin, McPhee, and Waskesiu Lake’s, Resort Village of Elk Ridge and businesses in the District of Lakeland, Village of Christopher Lake, RM of Paddockwood, Prince Albert National Park (Waskesiu), and Prince Albert. General mail-out to surrounding communities including, Village of Christopher Lake, Paddockwood, Candle Lake & Albertville.

A digital adaption of the magazine is made available online, and as a PDF download. The publication is also electronically shared through social media and targeted email platforms.

2.    Timelines

Early Booking Rates will be offered for ads booked and purchased by March 1st, 2024.

Final Booking and Payment Deadline is April 8th, 2024.

Artwork is due by April 12th, 2024. Any modifications requested after this date may incur additional fees. The publisher reserves the right to refuse changes that cannot be accommodated within the production schedule.

The Lakeland Cabin Stuffer is published annually, with expected distribution on or before the May Long Weekend, 2024.

Cancellations are permitted up and until April 1st, 2024. Cancellations after this time will not be refunded. 

Payment of invoice by the above timelines must be received to secure reservation in the publication.

3.    Ad Development & Artwork Submission

The client shall be responsible for providing ad material necessary to meet publication deadlines – including all artwork and/or digital files in adequate format and quality for print and digital publication. be smart communications reserves the right of refusal and will notify the client if it rejects ad materials due to unsatisfactory technical quality, inappropriate content, or any other reason.

Additional fees may be charged if ad development is required (ie: design, typesetting, optimization or digitization). Development rates are billed at $50/hour (unless otherwise agreed upon).

be smart communications retains all rights, including copyright, to designs that represent the creative effort or contain newly created material. The Client retains ownership of all provided material and remains solely responsible for the contents of the ad and for compliance with any laws regulating such advertising.

Any ads created by be smart communications shall not be reproduced, replicated or used for any other purpose without prior written approval.

High-resolution Adobe PDFs are preferred for all ads. Other electronic file formats accepted include Photoshop (flattened), EPS, TIF and InDesign files. All images should be 300 DPI in CMYK colour space.

All advertisements are subject to approval by be smart communications. The publisher reserves the right to reject or modify any ad for any reason, including but not limited to unsatisfactory technical quality, inappropriate content, or violation of any applicable laws or regulations.

5.    Fees

Payment for advertising in the Lakeland Cabin Stuffer is due by March 1st (for Early Booking Discount), or April 8th (Final Booking Deadline) unless otherwise set out in the Client’s payment terms. Only bookings with complete payment received by the due invoice date will be considered confirmed bookings.

An invoice will be emailed to the Client and the cost will reflect the size and specifications of the ad space. Cheque, electronic funds transfer, Visa, or MasterCard are accepted.

Payments for advertising in the Lakeland Cabin Stuffer are due by the specified deadlines. Failure to complete payment by the due invoice date may result in the ad not being published, and a service charge of 3% per month will be added to any invoice not paid within 30 days of billing.

6.    Placement

Specific placement in the publication is at the full discretion of the publisher. Only the premium locations identified on the rate sheet may be reserved, and are based on a first come, first serve basis. In the event of multiple requests for a specific premium location, a maximum two-year consecutive placement limitation will be applied. After which, that premium location will be open to the advertiser ‘next in line’ (if any).

7.    Cancellation Policy

Cancellation of any advertisement  must be received in writing from you before April 1st, 2024 in order to receive a 100% refund on advertising placement. If design work has been completed, this portion will not be refunded. Any cancellations after this date will be subject to a cancellation fee of 100% of the cost of the ad.

8.    Warranties & Indemnity

Where the Client provides materials (including all Intellectual Property Rights to all elements of text, graphics, photos, designs, trademarks, or other artwork in the course of the project), the client guarantees ownership or permission to use them. The Client grants be smart communications a royalty-free license to use or alter provided materials under the scope of this project and to use representations of the designs in a portfolio (as a sample of past works), on be smart communications website and social media sites, in trade publications, educational and promotional material.

The advertiser is solely responsible for the content of the ad, ensuring it complies with all applicable laws and regulations. The advertiser agrees to indemnify be smart communications against any legal claims arising from the ad, including but not limited to infringement of intellectual property rights.

be smart communications will take great care to ensure the client is represented by high-quality printing standards, however, no warranties or guarantees are made in the reproduction quality or accuracy of the material produced in the publication.

9.    Right to Refuse

be smart communications will not accept advertising that it determines, in its sole discretion, will reflect poorly upon be smart communications, other clients, its readers, and/or the long term use of this advertising medium.

10.   Force Majeure

Neither party shall be held liable for any failure or delay in performance under this agreement if such failure or delay is caused by events beyond the control of the party, including but not limited to acts of God, natural disasters, acts of government, or other unforeseen circumstances.

11.   Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information exchanged during the advertising process. This obligation of confidentiality survives the termination of this agreement.
